1. THE SCOPE OF TOYS FOR WHICH CE MARK IS NECESSARY
1.1. Definition of TOY Directive 88/378/EEC defines toys as any product or material designed or clearly intended for use in play by children of less than 14 years of age.
1.2.
Main objective
The main objective of the Safety of Toys Directive is the protection of the health and safety of children, and thus to prevent, as far as possible, the placing on the market and putting into service of unsafe or otherwise non-compliant toys.
2. Satety of TOY Directives:
2.1
Essential requirements
The essential safety requirements for toys are contained in Annex II of the Directive.
General principles

Users of toys must be protected against health hazards and risk of physical injury when toys are used as intended or in a foreseeable way, bearing in mind the normal behaviour of children |

The degree of risk present in the use of a toy must be commensurate with the ability of the users |

|
Labels on toys and/or their packaging and the instructions for use which accompany them must draw the attention of users or their supervisors fully and effectively to the risks involved in using them and to the ways of avoiding such risks. |

NOTE: Fulfilment of harmonized standard is usually presumption of compliance with essential requirements. However, at present the harmonized standard EN - 71 Safety of Toys is being amended and manufacturer of selected toys (plastics, textile) could respect also proposed new parts (drafts) of the standard for right performing of conformity assessment.
2.2 Conformity assessment procedures and affixing of CE marking
Toys directive contains 3 possibilities of conformity assessment.
Internal production control (Module A)
The manufacturer can take responsibility for ensuring that the product complies with harmonised European standards and can affix the CE Marking. Module A is sometimes referred to as 'self-certification'. With respect to last note could be realised procedure EC type examination .
EC type-examination (Module B)
This procedure is used provided that the applied harmonised standard does not cover all the essential safety requirements set out in Toys Directive. The present situation is typical for this provision.
EC type examination is the procedure whereby the Notified body ascertains that the toy fulfils essential safety requirements set out Toys Directive. If the findings conform to the provisions of Directive, EC type-examination certificate is issued.

Conformity assessment procedure is complete provided when the manufacturer realises following steps according to Directive |

to ensure that the product complies with harmonised European Standards EN - 71 and with the new proposal parts this standard or others technical documents containing the comparable requirements. |

to assemble technical documentation for submission to the Notified Body |
c)

to make application for EC type-examination to the Notified Body and to receive EC type-examination certificate for toy |
| e) |
to affix CE marking |

NOTE: Toys Directive does not require to draw up a EC-Declaration of Production Conformity , only affixing CE marking by prescribed way is necessary.
EC type certification (supplement of Module A)
As supplement to the first possibility of 'self-certification' is procedure EC type certification performed on the manufacturer's request provided that the applied harmonised standard covers all the essential safety requirements set out in Directive 88/389/EEC. If the findings conform to the provisions of Toys Directive EC type certificate is issued.

2.3 Other applicable directives
Toys containing electrically driven components may only bear the CE marking when they satisfy the requirements of the European Directive for the Safety of Toys as well as the essential requirements of other applicable European directives. For electric toys this means that also fulfilling of the essential requirements specified in the EMC directive. Toys with the remote control belongs also to Directive 1999/5/ES for radio and telecommunications terminal equipment.
